Are 49cc pocket bikes footpath legal?

I was wondering if 49cc pocket bikes were footpath legal? I'm just curious as my dad and I have an old mini bike style rolling chassis and we were wondering if we put a 49cc pocket bike engine whether it would be considered like a moped because of the engine size?

in most states a 50cc powered bike etc needs to be dual powered if it is to be considered legal.
eg putting a 50cc onto your mountain bike still requires the pedal drive system to still work.

Same as vic then, with pedals
However i never knew a cop that is a dyno via eyesight.. (petrol motors can be used if power output is under 200w)
 
Chuck a 2000w electric bad boy in there and take the 2000w sticker off. No cop would know and it would fly

In vic, they no longer have to prove that its overpowered to book you..
you have to take it to court

all this is since a police chase involving a stealth electric wild powered bike
